KEEPING DEAD BODIES SINCE 1967

Israel has been keeping dead bodies of Palestinians  for more than 57 years dating back to 1967 . When it comes to Palestinians, Israel adopts a policy to oppress all equally. 

The dead, regardless of whether they had been charged or found guilty of any offence by Israel’s own Courts are not returned to their families. 

KEEPING DEAD BODIES SINCE 1967

The dead are either kept in freezers or buried in military cemeteries. In a further cruel move to humiliate the Palestinian community, Israel does not even bother to mark the graves of the dead.

Families claiming dead bodies of their relatives have to do DNA tests to identify the deceased due to Israel’s deliberate negligence and lack of human compassion.

KEEPING DEAD BODIES SINCE 1967

We remain steadfast to continuously call out Israel’s blatant disrespect to any laws including their own. A Policy of oppression will not be able to defeat the truth that is upheld by the law. What Israel has been doing since its foundation is using all means including distortion and misuse of the law to enable oppression.

Israel is more than determined to collectively punish Palestinians even on a law that no longer exists or a law that has no legal jurisdiction on them. On top of that, the law relied on is not even faithfully adhered to by Israel.

What does Israeli Law say?

Israel’s favourite oppressive law Regulation 133(3) of the Defense Emergency Regulations 1945 states that :

it only applies to a person that has been lawfully convicted of a serious crime that warrants execution

The person has been legally executed in prison and;

The person MUST be buried in their own community

If Israel actually respect their own law, they would give a fine reading of the said provision. Nowhere in this the Emergency Regulations give power to withhold any dead bodies especially on civilians.

Israel has forever been in a state of emergency, with the very first Proclamation of Emergency in 19th May 1948 never been revoked even after 76 years since Israel’s establishment

What happens when an emergency is declared?

When the government declares an emergency, the Legislative Branch would then lose their power to enact laws. 

Precedence would be given to the Executive Branch in enacting emergency laws as the country is in a “state of emergency”

What does this mean to Palestinians in the West Bank and Gaza?

This means that Israel can use Emergency Regulations, ie the Palestine Defence Emergency Regulations 1945 within Israel. This law has allowed detaining people without charge or trial, demolish homes, withhold corpses, expelling people and putting civilians in military courts.

Laws Imposed Outside of Israel

But the issue lies in why is Israel enforcing this law on Palestinians outside of Israel, ie the West Bank and Gaza. As stated in previous postings, Israel has no jurisdiction to impose their laws outside of Israel.

All arrests, orders and procedures made by Israel on the West Bank and Gaza are void and illegal from the start as Israel has no jurisdiction outside of their borders set by the United Nations Resolutions.

Israel must return all Palestinians, dead or alive from Israeli Prisons and Detention Centres. All orders including movement restriction orders, curfews, expulsion and home demolition are void and must be revoked.

Israel has to continue living in a state of “grey lines” by delaying to adopt a Constitution as Israel is forced to do these if they have a Constitution : 

Acknowledge borders that would be detrimental to settlement expansion

Human Rights for all including : right to property and movement for Palestinians

What Israel has : 

Israel only have “Basic Laws” enacted by the Knesset. It’s not a Constitution but these laws have constitutional status

What Can Israeli Courts do:

The Courts can review “Basic Laws”, overturning any law that is against the Basic Law. This includes reviewing government decisions such as military decisions. This is why the Knesset passed a law to limit the Court’s powers.

Other Countries:

The Constitution has supreme power. The power is delegated to other branches. In short, all power is sourced from the Constitution, and no branch can be “above” from the constitution

Israel:

Since there is no Constitution, it is unclear which branch has power to do something or how much power a branch has. 

The Knesset passes “Basic Law”, a series of law that has constitutional status, where the Courts can review any law that is against “Basic Law”. 

It is universal thought that the judiciary must not usurp the powers of the Executive or Legislative branch.

By not having a Constitution, Israel continues to trap itself in more chaos and uncertainty. *Refer to previous postings and the reasons above on why Israel is reluctant and continuously delays on having a Constitution

It seems Israel prefers to be in much confusion rather than returning Palestinians their rights

Not having a Constitution is especially detrimental for Israel as there is no clear separation of power on the three branches - legislative, executive and the judiciary.

In countries with a Constitution, the Constitution gives power to the three branches - executive, legislative and judiciary. So, there is a clear separation of power where one branch cannot infringe the other

There is a lot of confusion in the real powers and limitations of each branch in Israel, with the judiciary having powers to review not only laws but also government proceedings in their Parliament (Knesset). 

Most countries have specific laws that disallows Courts from intervening the parliament as the parliament enacts and governs the passing and enforcement of laws. The duty of the Court is not to create new laws, but it is to interpret the laws.

It is an entirely different situation in Israel as there are infringements in between the branches. As a result of preferring not to have a Constitution and to continue in a state of lawlessness, this chaos and confusion ensues.

We wish to reiterate that Israel has no jurisdiction over the West Bank. This is per the UN Resolution 1947 and 1967 in which Israel’s Declaration of Establishment 1948 promised to be faithful to the UN. 

Israel must withdraw and not impose their laws on Al-Quds and the West Bank to be compliant with their own Declaration of Establishment 1948.

In today’s post, we will explain to the public why a charge is important and remind those “practising law” in Israel on their blatant abuse of the law. 

Before a person can be detained, they must be charged to : 

[WHY IS A CHARGE IMPORTANT]

1) To notify the detainee/accused 

All accused/detainee has a right to know “why” they are being detained and on “what” offences or grounds the Police/IDF are arresting them

[WHY IS A CHARGE IMPORTANT]

2) To allow the detainee/accused to prepare his/her defence

A charge allows the detainee/accused to prepare their defence as the Courts MUST hear from both sides.

[WHY IS A CHARGE IMPORTANT]

This brings a lot of questions to us in the legal field,

Is the findings of Israeli Courts even credible without hearing their defence?

Can Israeli Court be sure that the evidence presented by IDF/IOF credible?

Can Israeli Court be certain that the evidence corroborates with any offence?

As we have stated in previous posts, 

Israel has no jurisdiction to even detain the Palestinians as the West Bank/Gaza does not form part of Israel

We urge the release of ALL PALESTINIANS DETAINED WITHOUT DUE LEGAL PROCESS AND ADMINISTRATIVE DETENTION in Israeli Prisons.

[Why Israel is reluctant in adopting a Constitution]

Having a constitution highlights all powers, restrictions and due process of law in a nation. Important provisions such as citizenship, treatment of foreigners, applicability of law and jurisdiction are essential. Nonetheless, Israel’s reluctance in adopting a formal Constitution stems from their aim to continue occupation and expanding settlements.

If Israel has a formal Constitution, they would have to recognise Palestinians’ rights, citizenship status and territorial jurisdiction. 

For example, the Basic Law : Human Dignity and Liberty offers protection to Israeli settlers in the West Bank whilst Palestinians does not have protection. Our question is, how does a foreign law apply in another nation? 

In the case of Silwad Municipality v The Knesset, the court invalidated the Land Regularisation Act which provided a mechanism to expropriate usage rights on private Palestinian land on which settlements are built in exchange for compensation. The invalidation is based on it being ultra vires with Basic Law: Human Dignity and Liberty.

The Court refuses to determine the general applicability of this law; whether Palestinians may also enjoy protection from it. Chief Justice Hayut even stated ‘there was no need’ to decide on such. 

The intentional use of selective constitutional law allows grey areas to continue. These legal grey arrears are beneficial for the occupation and expansion of settler projects to continue as;

1) It is unclear on which law is applicable 2) It is unknown whether Israeli settlers can be sued for trespass  3) It is unknown whether Palestinians can enjoy protection 4) It is unclear whether the West Bank forms part of Israel or is sovereign (as foreign Israeli law is applicable to settlers & disputes)

With these uncertainties, where does Palestinians seek redress? Any country with equal rights may apply for injunction at Court, sue squatters for trespass and claim damages. This is entirely unavailable for Palestinians as the legal system created by Israel allows for continues oppression.

The nature of criminal liability is that a punishment must be inflicted based on the individual’s wrongdoing and when the individual can be accountable for a crime. For this reason, criminal punishment is inflicted on living individuals.

Nonetheless, Israel imposes home demolishment orders even when the alleged perpetrator has passed. 

We cannot comprehend the idea of demolishing a person’s house when he has yet to be found guilty. Even more when the person has passed. 

These leaves nothing but injustice to the family members, persons residing in the building or even the landlords who has nothing to do with the alleged offence.

This practice of home demolishment should be put to an end once and for all. Being a piece of legislation from the British Mandatory Period, Israel must repeal this abusive law.

How can a foreign country imposed their laws on another nation when they are not even citizens of that country?

Israel being a creation of the United Nations, are bound by the United Nations resolutions and borders which specifically creates which areas form part of “Israel”.

It’s no surprise that a country without a formal Constitution may easily get confused in understanding the real meaning of “sovereignty” and “respect for the rule of laws”.

The West Bank is not even part of Israel, the Palestinians are not even granted Israeli Citizenship. Why and on what basis is Israel detaining Palestinians in their own soil when Israeli law only applies within Israel.

Can you imagine if your neighbouring country imposes their laws on your soil when you are not even a citizen of that country?

I am not condemning anyone to genocide.

I just recognise it and who the real victim is.

You can't simply excuse everything as something that happens in war.

It's like saying the Holocaust was excusable because it was World War.

I say the eyes are blind because how can you be okay with any child suffering the way they do in Palestine.

Where they've been detaining children which I see you didn't deny.

Why would these children be any different?

Why?

When their families can't even get the bodies of those who died in detainment because apparently the sentence isn't over.

What sentence does a corpse serve?

The point here is that it's a genocide.

There are several international laws breached by the IDF and that includes leaving hospitals alone.

Leaving all these public residencies alone.

Countries that have been colonised already see what this is.

From their apartheid to the famine.

War is never an excuse for any of these.

$317.9 billion dollars.

just two years ago america committed over $3.3 billion dollars in assistance.

99.7% of those funds went towards their military.

I never implied it to be the holocaust. I meant literally their entire time with Moses. The many prophets sent to them after Moses as well.

You would argue it's about the Holocaust but I've seen protests where Holocaust survivors condemn Israel's actions.

Outside of the West, the world has already seen what it is.

Genocide is genocide. Regardless of race or religion. Because while you can deny Palestinian Jews exist, there are Christian Palestinians. This isn't a fight against terrorism, this is genocide.

For a lawless state with no constitution, no borders, calls the UN resolutions unbinding, they don't even follow their own laws.

It's Genocide because they kill regardless.

That's what it is at the end of the day.

The Isreali Army are quite literally posting about their crimes in social media. It's on their bloody tinder page.

Their history has been warning after warning not to be arrogant which they've failed to heed time and time again. The jews were only able to practice Judaism freely in the middle east because of the Islamic Empires then.

Complying to the demands of someone after they've destroyed everything you have IS Slavery! What else would it be?

It's everywhere in history. No different from stealing a living person from their homes, forcing them to provide labour in exchange for what? A roof over their head? Some bare clothes?

Israel is even withholding water from the Palestinians. A very basic essential for humans to live.

They don't even allow the Palestinians to collect rain water.

They shot down cattle, birds, sheep and even uprooted olive trees that have been cultivated in farms for years.

You can't lie about how nature works.

They said Rafah was safe and they still bombed those refugee camps.

They raided the last functioning hospital left and killed civilians and patients inside.

You want to argue a conspiracy theory on another person's tragedy. Their entire lives are just entertainment for you. A sensational plot to some movie you're gonna see on the screens.

The allies of Isreal are even horrified of their actions. The presidents, prime ministers all speak of a ceasefire.

Ignorance is no sin, but staying ignorant is.

Believe what you will then, live vicariously in your safe little bubble.

It isn't when you raid a hospital full of civilians.

Aid workers in clear uniform are shot dead by the IDF.

You wanna argue about Oct 7 then what year?

Am I supposed to assume a ten year old girl with cancer was justifiably detained while on life support?

Israel has even claimed the UN as non binding, non credible. The United Nations, who created their state in the first place.

They can't even decide who's in charge. There's a president AND a prime minister.

It's a lawless state with no constitution, no borders, a separate Judaism Court that rejects Palestinian converts and dares to flag itself as safe for all jews.

They literally bombed the WCK truck three times. They gave that truck clearance, their drones are capable of identifying license plates and it's pretty hard to say it was an accident when they bombed the roof. Where the logo was clearly marked all over it.

This is a white truck in broad daylight. The only reason this ever got coverage was because of the six non-Palestinians that they killed with it.

They said that Israel was a state safe for all Jews. Then why did they give the Ethiopian Jews contraceptives? Why are most of the Jews that are actually getting citizenships and fair treatment all from Europe and America. If anyone had a right to that land it would've been the Ethiopian Jews who were actually living in the middle east.

You want to tell me this is different from the Nazis selectively killing red haired people in the World War?

In Israel they have Judaism Law to deal with converts. Yet if a Palestinian wants to convert, they are not only rejected but they could be killed or worse detained and tortured.

How is this safe for All Jews when only a select few get to live comfortably?

There is a law established in the 1990s, that mandates Israeli homes to have bunkers. And for what?

They don't have any natural disasters to watch against.

The Palestinians certainly didn't have any bunkers underneath their tents or apartment buildings before the war.

Even states like California who are prone to Hurricane Katrina don't have every house mandated a bunker.

They were expecting war.

They destroyed the schools, homes, markets, hospitals that have ever existed in Gaza. All their means to live a normal life completely stripped away.

You want them to comply after all that?

That's straight up SLAVERY.

Call it what it is.

A two state solution has brought nothing but divide in places where peace had already existed. Brought about by colonists who had them at each other's throats, spreading hate and furthering the divide to benefit their own games.

History is a pattern. It's been done before.

It is not the eyes that are blind but the heart.

A two state solution is ridiculous. Israel deserves nothing after what they've done and Palestine deserves everything, their own land and their freedom!
