Happy Canada Day, all. I’ve been spending the day bitterly reading through the decisions SCOTUS just dropped, and I figured I’d brief the Canadians on here about how your equality rights work in Canada (not legal advice).

Equality rights are in section 15 of the Canadian Charter of Rights and Freedoms (1982). I’ll start with a bit of historical context, but skip if you’re not interested. In 1982, Canada changed its constitution to get full independence from GB. This happened under the liberal government of Trudeau I and around the same time as the Multiculturalism Act. If you want to dig into the juicy stuff, look up the story behind why the province of Quebec hasn’t signed the Constitution.

Anyways, the CCRF applies to government action (various human rights statutes cover individuals at the provincial level) and covers everything from freedom of expression (not just speech); freedom of religion and conscience; the right to life, liberty, and security of the person; and equality rights in section 15:

15. (1) Every individual is equal before and under the law and has the right to the equal protection and equal benefit of the law without discrimination and, in particular, without discrimination based on race, national or ethnic origin, colour, religion, sex, age or mental or physical disability.

Pretty self-explanatory. The list has been expanded by case law to include things like marital status (Miron v. Trudel, [1995] 2 SCR 418) and sexual orientation (Vriend v. Alberta, [1998] 1 SCR 493).

However, the there is also section 15(2):

Section (1) does not preclude any law, program or activity that has as its object the amelioration of conditions of disadvantaged individuals or groups including those that are disadvantaged because of race, national or ethnic origin, colour, religion, sex, age or mental or physical disability.

Although the legal side of things can get more complicated, and I’m by no means an expert in 15(2) literature or criticisms, I think it’s pretty damn awesome. Stay safe, cheers to section 15(2), and happy Canada Day.

You have the right to remain silent. Anything you say can and will be used against you in a court of law. You have the right to speak to an attorney, and to have an attorney present during any questioning. If you cannot afford a lawyer, one will be provided for you at government expense.

If someone knows other languages and can translate this, that would be wonderful because cops are no longer obligated to tell people their rights. This puts everyone but cops at risk. Let's make sure everyone on Tumblr knows.

Okay in light of the absolutely ridiculous developments in the UK, I can't be the only one who's noticed that France, the US, and the UK are ALL collapsing and they ALL based their current gov. systems off one another at around the same time in history, right?

Are you American? I highly doubt you are, because no American on tumblr would say this with a straight face. Actually, I'm assuming you're british, and I would say with certainty that since no religious laws have been imposed over there (yet) you guys are actually holding it together pretty well. Though of course, the diminishing support of the monarchy and the mass resignation are still things that need to be handled.

My friend, not even two years ago conservatives stormed the capital, roe v wade didn't just "piss voters off" it showed us exactly how unchecked the Supreme court is, as well as the fact that it was a ruling based off of "christian" beliefs and we are supposed to have freedom of religion in America, We live in a police state where over a thousand people have been killed by the police and its only July, In 2016 a president was elected that the citizens did not choose because the Electoral College is also extremely unchecked, rampant homelessness, the Govt. refuses to outlaw or at least place restrictions on guns despite there having been over 300 mass shootings this year etcetera etcetera

In France, the situation isn't as bad to my knowledge? French followers correct me if I'm wrong, I have a bit of an American bias toward European countries, but from my research, the people of france don't seem to like their president very much, and of course, the systemic banning of women from wearing a hijab, which has had multiple laws baked in so that it is harder to free hijabi women, despite France being known and beloved for fashion and scarves being a big part of that, though scarves themselves are not banned.

Links if you wanna fact-check me, but don't expect everyone else to be this nice. You can't always expect strangers on the internet to give you information and links. If you see a post on tumblr and you go, "Hmm, I don't know very much about this issue" go google it instead of saying that there isn't a problem. You sound very "There is no war in Ba Sing Se" and it's disconcerting. People are dying and its not being talked about because they're marginalized groups. Stay educated.

This is awful. It's horrifying. It's deeply depressing. Rage. Scream. Mourn the tragedy we know is coming.

But remember this: what we are about to experience is the world our grandmothers and great grandmothers lived in. This is what they fought against.

Remember that they won. Even if the victory was temporary, they still won.

We can win, too. Prepare yourself. Finish your mourning, and get back to the fight. Yes, it's awful that we have to have this same fight. It's frustrating. It's heartbreaking. But now is not the time to surrender to despair.

Now the work begins.

I need each and every person who sees this to pay attention to what is going on with the Indian Child Welfare Act.

The same SCOTUS that refered to tribal land as a territory of the state is about to hear a case that might overturn ICWA.

ICWA allows Alaska Natives and Native Americans control over the adoption and foster care placement of Native American and Alaska Children. In practice what this ensures is that if a Native American or Alaska Native child cannot be raised with their parents', the extended family will be given custody. If the extended family cannot care for the child, the child is placed with a family in their tribe or, barring that, with a family who is Native American or Alaska Native.

This act is important for two reasons:

For centuries, Native Americans and Alaska Natives were forcibly assimilated into White culture. From the 1800s to the late 1900s, children were taken from their families and either adopted out to White people or put in boarding schools. If parents refused, they were sometimes incarcerated, and they could lose custody of their other children. There are cases where tribes would hide their children and tell people who came that they had none...so the white people started showing up uannounced. The children sent to these schools were abused. Some were murdered. And survivors still live with the trauma. ICWA was passed to stop this...but not even 50 years after it being passed, it's at risk.

Native Americans and Alaska Natives are constitutionally guaranteed sovereignty. We all know the government picks and chooses when it wants to honor that, but Native Americans and Alaska Natives are supposed to have sovereignty. The idea that one country can step in and tell sovereign tribes and nations that they are not allowed to control the placement of their own children should be absurd. The U.S. doesn't tell Britain what to do with their foster care system...but the SCOTUS knows that Native Americans and Alaska Natives don't have an army or navy like Britain does. Because of this the SCOTUS believes it has the right to violate years of precedent and treaties. It knows that it will be protected no matter what it decides.

So I'm asking people to keep an eye on ICWA. I'm asking them to boost the signal. And I'm asking them to protest if it falls.
